Please read these Terms and Conditions ("Terms") carefully before using the Cedarly mobile application (the "App"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

1. Acceptance of Terms

By accessing or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. These Terms constitute a legally binding agreement between you and Cedarly.

2. Description of Service

Cedarly is a mobile application designed to help users apply sermons to daily life through trackable action items. The App provides:

• Sermon Browsing: Access to sermons with summaries, action items, and links to video content.
• Action Item Tracking: Ability to create, manage, and track daily completion of action items.
• Progress Monitoring: Tools to view your progress, streaks, and completion statistics.
• Notifications: Optional push notifications for daily reminders about incomplete action items.

3. User Accounts

The App does not require you to create an account or provide login credentials. You may use the App anonymously. However, you may choose to provide optional profile information (such as country and home church) to enhance your experience.

4. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree NOT to:

• Misuse Content: Reproduce, distribute, modify, or create derivative works from sermon content without proper authorization.
• Harmful Activities: Use the App to transmit any malware, viruses, or harmful code.
• Reverse Engineering: Attempt to reverse engineer, decompile, or disassemble any part of the App.
• Unauthorized Access: Attempt to gain unauthorized access to our systems, databases, or other users' data.
• Interference: Interfere with or disrupt the operation of the App or servers hosting the App.
• Abuse: Use the App in any way that violates applicable laws or regulations.

5. Intellectual Property Rights

App Ownership

The App, including its design, functionality, code, graphics, and user interface, is owned by Cedarly and protected by copyright, trademark, and other intellectual property laws.

Sermon Content

Sermon content (including titles, speaker names, summaries, action items, thumbnails, and YouTube links) is provided by content creators and administrators. This content remains the property of its respective owners. You may view and use this content within the App for personal, non-commercial purposes only.

User-Generated Content

Any action items or notes you create within the App are your own. By using the App, you grant us a license to store and process this content solely for the purpose of providing the App's functionality.

6. Third-Party Services and Content

YouTube Links

The App may contain links to YouTube videos. These links are provided for your convenience. YouTube is a third-party service not owned or controlled by Cedarly. Your use of YouTube is subject to YouTube's Terms of Service and Privacy Policy.

Third-Party Services

The App uses third-party services including Supabase (for data storage), PostHog (for analytics), and Expo (for app infrastructure). Your use of these services is subject to their respective terms and privacy policies.

7. Disclaimers

No Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

Content Accuracy

While we strive to provide accurate sermon content, we do not guarantee the accuracy, completeness, or reliability of any sermon summaries, action items, or other content displayed in the App. Sermon content is provided by third-party administrators and may contain errors or omissions.

Service Availability

We do not guarantee that the App will be available at all times, uninterrupted, or error-free. The App may be subject to maintenance, updates, or technical issues that affect availability.

Religious Content

The App contains religious content. We do not endorse or take responsibility for the theological views, interpretations, or recommendations expressed in sermon content or action items. Users should exercise their own judgment and discretion.

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, CEDARLY AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:

• Loss of data, action items, or progress information
• Loss of profits or business opportunities
• Service interruptions or unavailability
• Errors or inaccuracies in content
• Any damages arising from your use or inability to use the App

IN NO EVENT SHALL OUR TOTAL LIABILITY EXCEED THE AMOUNT YOU PAID TO USE THE APP (WHICH IS CURRENTLY ZERO, AS THE APP IS FREE).

9. Data and Privacy

Your use of the App is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. By using the App, you consent to the collection and use of information as described in the Privacy Policy.

Local Data Storage

Action items and progress data are stored locally on your device. You are responsible for backing up your data if desired. We are not responsible for any loss of data resulting from device malfunction, deletion, or App uninstallation.

10. Push Notifications

The App may send push notifications if you enable this feature. You can disable notifications at any time through your device settings or the App's Settings tab. Notifications are sent based on your preferences and are subject to your device's notification settings.

11. Modifications to the App or Terms

App Modifications

We reserve the right to modify, suspend, or discontinue the App or any part of it at any time with or without notice. We are not liable for any consequences resulting from such modifications.

Terms Updates

We may update these Terms from time to time. We will notify you of material changes by updating the "Last Updated" date. Your continued use of the App after changes become effective constitutes acceptance of the updated Terms.

12. Termination

We reserve the right to suspend or terminate your access to the App at any time, with or without cause or notice, for any reason including but not limited to:

• Violation of these Terms
• Misuse of the App or its content
• Any conduct that we determine is harmful to other users or our service

You may stop using the App at any time. You may also delete the App and clear all local data using the "Clear All Data" feature in Settings.

13. Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.
